LISTEN&LEARN TERMS & CONDITIONS
- Where the client does not appear (client ‘no-show’) for a pre-arranged class, this class will be billed in full.
- There is to be no discussion of fees or billing status with the teacher.
- Any poaching of Listen & Learn's teachers will result in civil action.
- Any change of class size must only be made with the authorisation of Listen & Learn.
- A non-refundable deposit of £350 (£650 for intensive courses) must be paid prior to the start of the course. The balance of the invoice must be paid within 14 days of the start of the course.
- All late payments (more than one calendar month after the payment terms of the invoice have expired) will be subject to additional interest charges of 2% per calendar month. Interest will only be charged on the amount of the unpaid balance.
- All foreign (non-English) language courses in the UK and other EU countries (with the exception of the Republic of Ireland where no VAT is applicable on any language courses) and associated fees are subject to UK VAT. Courses outside the EU will not be subject to VAT.
- If cancelling or rearranging the date of a class which has already been arranged, the client must contact the teacher directly. Where the client is unable to contact the teacher, the client must telephone or email Listen & Learn, who will then contact the teacher. If the cancellation is made within two full working days of the scheduled class, the lesson will be billed in full.
- Materials supplied by Listen & Learn or the teacher, excluding course books and course work, are owned by Listen & Learn or the teacher.
- The client must treat their teacher with respect. If there are any problems relating to a teacher the client must contact Listen & Learn immediately.
- In the event that the classes are to take place in the client's home or the teacher's office, Listen & Learn may request that the client provide a character reference from a friend, family member, or colleague. This reference should attest to the client's good character, and is primarily for the comfort of both the teacher and the student (e.g. if a female teacher is teaching a male student at his home). Listen & Learn will provide teacher profiles on request.
- If there are problems with course content the client must contact Listen & Learn immediately.
- teacher delays due to transport problems will be rescheduled or, with the client's consent, the time will be made up at the end of the lesson. Client delays may not be made up (except by individual arrangement with the teacher).
- If the client is unfit for the session because of alcohol or drugs, the teacher may cancel the session. The client will be responsible for payment in full for the session.
- Where a class takes place inside a building, the client must not smoke during the class. If the client wishes to smoke, a suitable break must be arranged directly with the teacher, and the client must smoke in a separate area. The time of this break will be deducted from the total time of the class.
- Location changes must be agreed upon at least 2 working days in advance, either directly with the teacher or through Listen & Learn. Any increased travel expenses due to the change will be billed to the client.
- Clients will ensure that any premises (work or home) used for classes conform to basic Health & Safety standards and that the teacher is made aware of any necessary Health & Safety information (such as the location of fire exits and fire assembly points) applicable to a location.
- Where a teacher is unable to continue a course, Listen & Learn will provide an equally qualified, experienced and suitable replacement. Where this is not possible, a full refund of all outstanding sessions will be offered to the client.
- Where a client is unable to continue a course after the first session has been taken, a credit note will be issued for the balance of the invoice after the following deductions are made: the hourly cost of any classes already taken (including late cancellations); the cost of any course books already supplied to or purchased on behalf of the client by Listen & Learn; and, where less than the full number of classes invoiced have been taken, a cancellation fee of £350 (£650 for intensive courses). In the event that the client has not yet settled the invoice in full, the client will still be liable for payment of the difference between the amount already paid and the amended balance due.
- Where a client is unable to proceed with a course before the first session has been taken, a credit note will be issued for the balance of the invoice after deduction of the administration and teacher recruitment fee of £350.
- Any refunds from Listen & Learn will be made by Sterling cheque (within the UK) or banker’s draft in the appropriate currency (outside the UK).
- All disagreements arising from these Terms and Conditions shall be governed according to English law, and any matters arising out if it shall be subject to the jurisdiction of the courts of England and Wales.
